The content of these Operating Rules is not final. The Operator may from time to time extend, amend, and revise these provisions. The Operator is obliged to publish all such changes on the website www.365fitco.sk and in the premises of 365Fit&Co.
The Operator is obliged to keep the Operating Rules in a place freely accessible to staff, visitors, and members.
Article II
Type and Method of Providing Services
2.1 The Operator is a commercial company operating a sports and relaxation facility – 365Fit&Co. The premises of 365Fit&Co are located in the multifunctional complex GALLERIA EUROVEA, Pribinova 8, Bratislava. The aim and purpose of 365Fit&Co is sport activity and regeneration of its members. A member of 365Fit&Co is a natural or legal person who has signed a membership agreement by purchasing a membership. The Operator provides services related to a healthy lifestyle, in particular: Fitness & Cardio, Body & Mind, Wellness, massages, and other services within the field of physical culture.
2.2 365Fit&Co is positioned as a club of sport, relaxation, and a healthy lifestyle for adults, not as a youth club or a club for children.
2.3 The method of providing services means enabling members and visitors/clients to use the services of 365Fit&Co, based on proper payment of the membership fee in one of the forms stated in Article VII of these Operating Rules. Entry into 365Fit&Co is not permitted if there is a risk of exceeding the set capacity (capacity is determined by the Operator). For the purposes of these Operating Rules, a client means a natural or legal person who receives services from the Operator under these Operating Rules.
Article III
Operating Conditions and Health Protection Principles for Visitors/Members and Employees of 365Fit&Co
3.1 The premises of 365Fit&Co are divided into individual sections: Fitness & Cardio, Body & Mind, Wellness(hereinafter the “Sections”). The Operator maintains the premises of the individual Sections clean and orderly during service hours in accordance with Article IX.
3.2 When using equipment and items intended for activities under Article II, members must follow the manufacturer’s instructions for the equipment and the instructions of responsible persons in 365Fit&Co to avoid endangering health and/or damaging the Operator’s property or the property of others. Ventilation, heating, and lighting of the Sections are provided by the Operator. First-aid kits located in the Sections contain basic medical supplies and are regularly checked.
3.3 A notice prohibiting smoking and a notice prohibiting handling open fire are displayed in a visible place.
3.4 The hot tubs on the outdoor terrace of 365Fit&Co fall under the category of an artificial bathing facility pursuant to Decree No. 308/2012 Coll. and meet all operating conditions for such facilities. Accordingly, the bathing areas comply with the Decree regarding access as well as hygienic and technical measures:
a) Capacity is 12 persons and operation is seasonal.
b) Current information on water temperature in each pool and air temperature is posted daily in a visible place. The average temperature of the outdoor hot tubs is 35°C.
c) Cleaning and disinfection of operating surfaces, areas, equipment, and sports aids is performed daily by qualified staff.
d) During pool operation, continuous water recirculation and disinfection is ensured.
e) Given hot tub volume up to 10 m³ and a separate recirculation system, draining the entire volume is ensured at least once per month.
f) After draining, the pool including technical accessories in contact with water is mechanically cleaned, disinfected, and refilled with water meeting the requirements of Annex 3 to the Decree.
g) The Operator keeps proper records and performs daily measurements of water temperature, pH reaction, redox potential, free and combined chlorine values, and water transparency.
h) In addition, monthly measurements of the following water quality indicators are ensured: Escherichia coli, intestinal enterococci, Pseudomonas aeruginosa, Staphylococcus aureus, culturable organisms at 36 ± 1°C, producers/consumers, chemical oxygen demand (permanganate), copper, Legionella species, ozone, total organic carbon.
i) Maintenance and cleaning of pools is provided by a certified technician holding a certificate of professional competence.
j) Visitors must follow behavioral rules: shower before entering the pool; do not use the pool in case of any transmissible infectious or skin disease; comply with pool capacity; follow staff instructions.
k) Use of sports aids in the pools is not permitted.
3.5 The wellness area with saunas meets all operating conditions for body care facilities under Decree No. 554/2007 Coll. The Operator ensures adequate maintenance and sets the following rules for visitors in the sauna and cooling pool:
a) Sauna bathing is intended primarily for healthy persons. Persons with vascular and heart diseases may use the sauna after consulting a doctor. Persons with symptoms of acute illness (especially respiratory infections, fever, cough, runny nose, diarrhea, headache, malaise), persons with open purulent or bleeding wounds, etc., are not allowed. Entry is not allowed for persons with transmissible diseases, carriers, or those with a transmissible disease in their close environment. Entry is also prohibited for persons under the influence of alcohol or other intoxicants and for persons who are infested/dirty. Sauna staff are instructed on visible symptoms of the above illnesses. A complete and specific list of contraindications is posted in a visible place in the wellness area. Persons suffering from other illnesses use the sauna at their own risk, even if they sought medical advice.
b) Before entering the sauna, the visitor must shower thoroughly and enter without swimwear, dry, wrapped in a sheet. In the sauna, sitting/lying on the sheet is allowed if capacity permits.
c) Breathing through the mouth is recommended, as high temperature and dry air dry out mucous membranes and may cause headaches. Recommended stay is 10–15 minutes, depending on fitness; it may be repeated with breaks for showering or cooling pool use, and a shower is required before entering the cooling pool.
d) Proper behavior is required: do not speak loudly; be considerate of others.
e) In case of discomfort, the visitor must immediately seek staff assistance.
f) Children must not stay in the cabin without adult supervision.
g) Electrical devices are prohibited in the sauna.
h) Only the Operator or authorized staff may operate the equipment.
i) Sauna operation and cooling pool maintenance are ensured by qualified staff. Water from the sauna cooling pool is drained daily; walls and bottom are mechanically cleaned, disinfected, and rinsed with clean water. If a recirculation pool is used for cooling, water must be replaced at least once per month. Water quality control is carried out once every six months in the scope of indicators for recirculation pools stated in section 3.4 of these Operating Rules. Additionally, pH and free chlorine concentration are monitored and recorded daily.
j) Storage and cleaning of linen in the wellness area is ensured by qualified staff; linen is thoroughly washed and disinfected after each use.
k) Cleaning of the wellness area is performed by qualified staff several times per day to comply with hygiene and safe operation rules.
3.6 365Fit&Co may also provide massage services, performed exclusively by persons with professional competence (completed secondary education in the field of masseur or masseur for visually impaired).
3.7 Waste collection is ensured via waste bins placed appropriately and in sufficient quantity throughout 365Fit&Co. Waste removal is ensured by the landlord of the premises – GALLERIA EUROVEA, responsible for safe removal and waste handling.
Article IV
Membership, Member, Membership Fee, Membership Card
4.1 The terms membership, member, membership fee, and membership card are defined in the General Membership Terms of 365Fit&Co, which form an integral part of the membership agreement.
4.2 Types of membership offered depend on the Operator’s commercial strategy. Reception and sales department will provide complete information and current prices, as stated in the valid price list on www.365fitco.sk.
4.3 A member must comply with the membership agreement, General Membership Terms, and these Operating Rules.
4.4 Personal data protection is addressed in the General Membership Terms.
4.5 Each member receives a membership card enabling entry/exit and use of services according to membership type. The card is non-transferable. It is issued for the duration of the membership agreement. After membership ends (expiry of the agreement) … (sentence incomplete in the source text)
4.6 Membership does not automatically entitle the member to free participation in special courses, promotions, or other events.
4.7 Membership is continuous and cannot be interrupted/suspended, except as stated in the General Membership Terms.
Article V
Instructions, Restrictions, and Prohibitions for Visitors/Members
5.1 A visitor/member may use Sections, services, and purchase goods only in accordance with Article VII.
5.2 A member must present the membership card at reception and, upon request, also an identity document.
5.3 Only persons over 18 may use the Sections.
5.4 A person aged 10–18 (“Minors”) may become a member if purchased by a legal guardian who also signs a written consent (“Declaration”) stating:
-
the person is sufficiently acquainted with obligations under these Operating Rules and is mentally mature enough to follow them; and
-
the legal guardian remains fully responsible even if not accompanying the Minor in 365Fit&Co.
Minors (10–18) may visit only based on a signed Declaration.
5.5 If responsibility for a Minor is assumed by a fitness trainer under an agreement during a class/course and/or personal training, responsibility transfers upon the Minor entering the relevant Section and being taken over by the trainer. Until then, the legal guardian is responsible.
5.6 For safety reasons, children under 10 are not permitted entry.
5.7 With consent of a responsible person and under their accompaniment, a foreign person – a visitor – may enter. A visitor is a person who is not an employee/worker of the Operator, not a member, and does not enter to use services or buy goods. The visitor must follow all rules and orders.
5.8 Persons not allowed to use services:
-
persons whose health condition excludes safe sports/physically demanding activity;
-
persons under the influence of alcohol, narcotics, psychotropic substances or other addictive substances;
-
persons in dirty clothing/footwear or clearly inappropriate clothing or causing public offense;
-
persons banned by the Operator.
5.9 Staff and persons authorized to ensure safety/order may at any time request such persons to leave. This also applies to persons whose behavior disturbs or limits members, other visitors, or staff.
5.10 Disturbing/limiting includes verbal or physical attack, rude behavior, or threats. Such conduct is considered a gross breach. The person must comply immediately; otherwise, they may be escorted out.
5.11 In case of a gross breach, the Operator may deny entry or withdraw from the membership agreement (if concluded and valid), whereby membership ends without entitlement to refund of the membership fee.
Article VI
Obligations of Members and Visitors
6.1 Members/visitors must:
-
observe a strict no-smoking policy; smoking is considered behavior limiting others;
-
use equipment only as intended and behave to prevent damage and health risks; comply with hygiene rules, including using a towel when sitting/lying on equipment;
-
follow staff instructions;
-
use appropriate clothing, footwear, and gear;
-
in case of breach, leave the premises; a ban may be imposed;
-
accept that the Operator may temporarily restrict certain services (scope/quality) due to special events or technical/staff reasons; during such time, only designated persons may use the club/parts of it.
6.2 A member/visitor may request a reservation for a service; it will be made if the service type allows it.
Article VII
Use of 365Fit&Co Services
7.1 Members/visitors may use services only if they:
-
are members with a valid membership; or
-
are guests of a member, registered at reception, and agreed to these Operating Rules, and use is consistent with the member’s membership; or
-
have a paid one-time entry registered at reception and agreed to these Operating Rules; or
-
hold a Multisport or UpBalansea card and it has been scanned at reception before entry; or
-
are paying attendees of a one-time event organized/co-organized by 365Fit&Co.
7.2 Payment for services and goods is made before leaving:
-
cash payment at reception (or equivalent accepted by 365Fit&Co);
-
payment card accepted by 365Fit&Co;
-
payment from the membership card account, provided sufficient credit is available; otherwise the difference must be paid in cash/card.
7.3 The membership card holder may top up additional credit.
Article VIII
General Conditions of Stay in 365Fit&Co
8.1 Movement within Fit&Co requires using an activated membership card. All consumption and services beyond the membership are charged to the card.
8.2 Final payment is made upon leaving 365Fit&Co. For cash payments, the member/visitor must count change immediately; later complaints will not be accepted.
8.3 Users paying from account credit without sufficient balance must pay the difference at reception the same day. If a member forgets the membership card, they may use services if they present a valid ID so details can be verified and a replacement card issued. A fee may apply.
8.4 Lockers in changing rooms are used for storing items. The lock works via PIN code; the client is informed on first visit.
8.5 The Operator is liable only for damage to items stored in designated places under Article X.
8.6 If a member/visitor does not rent a locker, they must empty it and leave it unlocked when leaving.
8.7 If a locker is not emptied, the Operator may forcibly open lockers remaining locked after hours or after rental time. The Operator is not liable for losses/damage due to failure to leave it empty and unlocked.
8.8 The Operator undertakes to store items found in a forcibly opened locker for at least 14 days. When returning items, a one-time handling fee of €20 is charged.
Article IX
Multisport Card Holders
9.1 Multisport holders may use: fitness, wellness, group classes, bootcamp.
9.2 Per day, the holder may use only one of these services, max once.
9.3 Wellness limits:

max stay 60 min

wellness with Multisport between 08:00–22:00

total wellness stay is 80 min; after exceeding, a penalty fee €10 is charged
9.4 Fitness limits:

limited on certain days/times
-
Mon–Thu: reservation required 16:00–20:00; time limit 100 min from entry; after exceeding, penalty €10

free cancellation up to 2 hours before; later cancellation fee €10
9.5 Group classes & bootcamp:

max stay in 365Fit&Co 100 min from entry; after exceeding, penalty €10
Article X
Special Events
10.1 Special events are extraordinary, mostly one-time, announced sports events with defined services, limited scope and capacity, fixed price. Entry must be paid in advance and is non-refundable. Restrictions will be announced by posters on-site and on www.fitco.sk.
10.2 If a visitor provides a medical certificate at least 1 day in advance, they may offer purchased tickets for sale at reception. There is no legal entitlement to ticket resale.
Article XI
Liability
Visitor/Member liability for damage caused:
11.1 Must behave so as not to disturb others, prevent health/property damage, and not disrupt staff duties.
11.2 Liable for damage caused by loss of borrowed sports equipment, clothing, footwear, towels, keys, etc.
11.3 If by breaching duties or other legal obligations the member/visitor causes damage, they are fully liable under § 420 of Act No. 40/1964 Coll. (Civil Code), as amended.
Operator liability for brought-in or stored items:
11.5 For valuables properly stored in locked lockers (locked as instructed) for which keys/locks are provided by the Operator, the Operator is liable only up to €332. Valuables include mobile phones, cameras, photo equipment, jewelry, etc. Damage to any locker and loss of items must be reported without undue delay to a responsible employee.
11.6 Lockers are not intended for jewelry, cash, mobile phones, laptops, or other valuables.
11.7 A claim for damages must be made without undue delay; it expires if not claimed within 15 days from when the injured party learned of the damage.
Liability for defects in goods:
11.8 If goods purchased from the Operator have defects, the member/visitor may claim them within the warranty period at reception; proof of purchase must be presented.
Other liability:
11.9 Governed by § 420 et seq. of the Civil Code.
Misuse of membership card:
11.10 In case of card loss, the member must immediately notify 365Fit&Co and request blocking. Until blocking, the Operator is not liable for misuse by a third party.
Article XII
Method and Frequency of Cleaning 365Fit&Co Premises
12.1 Disinfection of surfaces and wet mechanical cleaning of floors and hygiene facilities is carried out during the night and also throughout the day as needed.
12.2 Waste bins are emptied throughout the day as needed.
12.3 Lighting fixtures and windows are protected against breakage by sufficient distance and are cleaned as needed.
12.4 Cleaning/disinfection is ensured by a contracted company. As of the date of issuance, cleaning is provided by: GEMINI – cleaning services, Kutlíkova 8, Bratislava, Company ID: 45319537, responsible person: Kristína Halásová, phone 0902 251 765.
Article XIII
Final Provisions
13.1 The Operator may amend/supplement these Operating Rules and the General Membership Terms based on operational changes, member requests, and feedback. Changes take effect upon publication in 365Fit&Co premises and on www.365fitco.sk. Members/visitors must familiarize themselves with updates.
13.2 The Operator may regulate specific rights and obligations in individual Sections in more detail.
13.3 Specific rules for Wellness are in Annex 1.
13.4 Specific rules for Body&Mind are in Annex 2.
13.5 Specific rules for Fitness&Cardio are in Annex 3.

Annex No. 1
Specific Rules for the Wellness Area
General Rules
1.1 These Specific Operating Rules supplement the Operating Rules pursuant to Article XII section 12.3. Clients of 365Fit&Co must behave in a manner that does not disturb the comfort of other members, does not cause damage to health or property, and does not interfere with the duties of employees and staff.
1.2 Opening hours are visibly posted. No person is permitted to enter outside opening hours.
1.3 Wellness services include: Finnish sauna, sanarium, steam cabin, ice generator, Kneipp path, and cooling pool for members.
Health Contraindications and Entry Restrictions
2.1 Wellness is intended primarily for healthy persons. It is not recommended for persons with cardiovascular disease, inflammatory internal diseases, respiratory diseases, psychosis, or claustrophobia.
Entry is prohibited for:
a) persons under the influence of alcohol or intoxicating substances
b) persons with animals
c) persons with infectious diseases, open wounds, skin diseases, or conditions endangering others
d) persons intending commercial or non-standard use without management approval
e) persons who are dirty or wearing contaminated clothing
f) children under 12 years
2.1.1 Persons unable to move or dress independently or with significant physical/mental disability may enter only with an accompanying person.
2.1.2 Children aged 12–15 may enter only with an accompanying adult and only until 20:00.
Prohibited in the Wellness Area
• smoking
• bringing or using glass objects
• photographing/filming persons without consent
• sexual or erotic behavior
• excessive noise
• running
• using sports equipment
• using cosmetics outside showers

Safety & Hygiene Provisions
Wellness is used at own risk.
First aid kit available per Ministry of Health regulation.
Biological contamination must be disinfected immediately using approved disinfectants.
Daily full cleaning and disinfection of sauna areas is required.
Cooling pool water must be drained daily unless recirculated (then replaced monthly).
Water quality tested every 6 months by public health authority laboratory.
Clean linen must always be used; clean and used linen must not mix.
Exceptions
The Operator reserves the right to grant exceptions.

Specific Rules for Body & Mind Area
General Rules
1.1 These rules supplement the Operating Rules under Article XII section 12.4.
1.2 Opening hours are posted. Entry only during opening hours.
1.3 Entry allowed only after opening and trainer presence.

Annex 4
Specific Rules for the Ice Bath (Cold Tub)
ICE BATH (COLD TUB)
SAFETY WARNING AND CONTRAINDICATIONS
The ice bath represents an intense strain on the body and may lead to serious health complications.
Use is VOLUNTARY and SOLELY AT YOUR OWN RISK.
The Operator bears no responsibility for:
• health complications during or after use
• consequences of incorrect or unprofessional use
• failure to comply with safety instructions
• withholding health information by the user
By using the ice bath, the user confirms that they are medically fit and aware of all risks. The Operator does not provide medical supervision or healthcare.
THE ICE BATH IS PROHIBITED FOR PERSONS:
• with cardiovascular diseases, high blood pressure, cardiac arrhythmias
• after a heart attack or stroke
• with vascular diseases, Raynaud’s syndrome
• with epilepsy or a tendency to faint
• with acute infections, fever, flu
• with blood clotting disorders
• with open wounds or skin infections
• under the influence of alcohol or drugs
• during pregnancy without a doctor’s approval
USER OBLIGATIONS:
• shower before entry
• enter the water slowly and in a controlled manner
• do not splash water around the area
• no jumping into the water and no submerging the head
• do not use the ice bath without another person nearby
• time spent in the bath is solely the user’s responsibility
• immediately end the procedure if feeling unwell, dizzy, chest pain, or shortness of breath occurs
• persons under 18 may enter only accompanied by a responsible adult who assumes responsibility
BY ENTERING THE ICE BATH, THE USER AGREES TO THESE CONDITIONS
AND ASSUMES FULL RESPONSIBILITY FOR THEIR HEALTH CONDITION.
